Strongineering Terms of Service

Welcome to Strongineering. These Terms of Service ("Terms") govern your use of the Strongineering mobile application and related services (collectively, the "Services") provided by Nestuary Wellness Inc. ("Strongineering," "we," "us," and "our").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By creating an account or using the Strongineering app, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.

2. Description of Service

Strongineering is an AI-powered fitness application that provides personalized workout programs, mobility assessments, exercise tracking, GPS-enabled conditioning activity tracking, and related fitness services. The Services are designed to help users improve their strength and conditioning through data-driven, adaptive programming.

3. User Accounts

To access certain features of the Services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Medical Disclaimer

IMPORTANT: Strongineering is a fitness tracking and coaching tool, not a medical device or medical service. The information and recommendations provided by our Services are for general informational and educational purposes only and should not be considered medical advice.

You should consult with a qualified healthcare provider before starting any new exercise program, especially if you have any pre-existing health conditions, injuries, or concerns. By using our Services, you acknowledge that you assume all risks associated with physical exercise and that Strongineering is not responsible for any injuries or health issues that may result from your use of the Services.

5. User Conduct

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Services in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any portion of the Services
• Interfere with or disrupt the Services or servers
• Upload or transmit viruses or any other malicious code
• Share your account credentials with others
• Use the Services to harass, abuse, or harm others

6. Subscription and Payment

Certain features of the Services require a paid subscription. Subscription fees are charged through the Apple App Store or Google Play Store according to the pricing and billing terms disclosed at the time of purchase.

Subscriptions automatically renew unless cancelled before the renewal date. You can manage or cancel your subscription through your App Store or Play Store account settings.

7. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, images, software, and exercise demonstrations, are owned by Strongineering or its licensors and are protected by copyright, trademark, and other intellectual property laws.

8. License and Restrictions on Use

Subject to these Terms, Strongineering grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and use the Services for your own personal, non-commercial purposes. We reserve all rights not expressly granted to you.

Except as permitted by these Terms or by applicable law, you agree not to:

• Sell, rent, lease, sublicense, transfer, redistribute, or otherwise make the Services available to any third party;
• Access, scrape, or collect data from the Services by any automated means — including bots, scrapers, crawlers, or scripts — other than through an interface or data-export feature we provide for that purpose;
• Reverse engineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works of the Services or any part of them, except and only to the extent that applicable law expressly permits this notwithstanding this restriction;
• Circumvent, disable, or interfere with any authentication, rate limit, or security measure, or any subscription, entitlement, or in-app-purchase check, or otherwise tamper with how access to paid features is granted;
• Use the Services, or any content or output you obtain from them, to build or train a competing product or service, or to copy the features, design, or interface of the Services;
• Remove, alter, or obscure any copyright, trademark, or other proprietary notice in the Services.

Nothing in this Section limits your right to export or obtain a copy of your own personal data where applicable law gives you that right. You may exercise that right through the features we provide or by contacting us.

9. User-Created Exercises and Submissions

The Services allow you to create your own exercise entries ("User-Created Exercises"). You retain ownership of the User-Created Exercises you author, and they remain private to your account by default. We do not publish, share, or display your User-Created Exercises to other users unless you explicitly choose to submit them as described below.

When you create a User-Created Exercise, we collect a limited set ofclassification metadata about it — the exercise name and the category, type, targeted muscle groups, equipment and logging basis you selected from our menus — so that we can understand which exercises our users need and prioritise which ones to add to our public catalog. This collection is described in detail, together with the legal basis for it, in our Privacy Policy, and you can turn it off at any time in Settings.

This collection is strictly limited to that metadata. It does not include your personal notes, your written instructions, your training history, your performance data, any media you link or upload, or any other information associated with your account. We do not store your account identifier alongside this metadata, and we do not publish, share, or display your User-Created Exercises to other users.

You represent that any exercise you create does not infringe the intellectual property rights of any third party and does not incorporate trademarked or proprietary program names. We are under no obligation to add any exercise to our catalog, and we may modify, rename, or decline to use any of it at our sole discretion. Where we do develop a catalog exercise informed by this metadata, the resulting catalog entry — including its name, written instructions, illustrations, and video demonstrations — is our original work and remains our intellectual property under Section 7. Nothing in this Section entitles you to attribution, compensation, or any ownership interest in a catalog entry.

Adding an exercise to our catalog never alters, replaces, or deletes your own User-Created Exercise or its associated training history. Your entry continues to function unchanged, and any decision to move your history onto a catalog exercise is yours alone and requires your explicit confirmation.

10. User Data and Privacy

Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Services, you consent to our collection and use of your data as described in the Privacy Policy.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STRONGINEERING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. STRONGINEERING DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Termination

We reserve the right to suspend or terminate your account and access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. The licence granted in Section 8 terminates automatically if you breach these Terms.

If you believe your account was suspended or terminated in error, you may contact us at the address below and we will review the decision.

You may terminate your account at any time by contacting us or through the app settings. Upon termination, your right to use the Services will immediately cease.

14. Changes to Terms

We may modify these Terms at any time. When we make significant changes, we will notify you through the app or by email. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.
